The Government still unsure about the Law on salaries in the public sector

 In its meeting held on the 23rd November 2016, the Government approved the withdrawal of a number of draft laws from the Legislative program of 2016 to be transferred in the Legislative program of 2017. Two of them  are directly related to the Public Administration Reform (PAR): 1) the draft law on amending and supplementing the Law on civil service, and 2) the draft law on amending and supplementing the Law on the state administration. Surprisingly, the third draft law which was not withdrawn from the Legislative program of 2016, equally important to PAR, was the draft law on salaries to be paid by the budget of Kosovo.

This decision is in contradiction with the agreement between the Government and the European Commission, which specifies that these three draft laws will be processed in one package, both at the Government level as well as at the Assembly level.   On the 9th of November 2016, the Government approved the European Reform Agenda (ERA) which stipulates that the planned legislation pertaining to civil service, salaries and organization of the state administration will be proceeded in a coordinated manner and based on the concept documents to be agreed on at the Government level. However, the three concept documents are in the drafting process in the Ministry of Public Administration (MPA) and will likely be submitted to the Government for approval around February 2017. After these three concept documents get the approval of the Government, MPA plans to draft the three laws along the year and submit to the Government for approval around November 2017.

The Prime Minister’s justification to proceed with the draft law on salaries relates to the fact that the draft law on salaries has been prepared for a long time now and is ready for approval. In the meeting of the 23rd of November, the Prime Minister requires from MPA Minister to prepare for approval as soon as possible the draft law on salaries in the public sector. Nevertheless, based on the supplement and change of the Legislative program 2016 with the decision of the 23rd of November, the draft law is going to be named the draft law on salaries to be paid by the budget of Kosovo and not the draft law on salaries in the public sector. Even worse, this hustle of the Government to proceed with the draft law on salaries is against the Government Regulation, which obliges the Government to organize public consultations with the civil society.
